Terms and Conditions

Brook Haven Village Builders and Developers (BHV) is the developer of the Brook Haven Village Villa Project located in Pampady, just 12 kilometers near to Kanjikuzhy, Kottayam, Kerala, India. The following terms and conditions are to be agreed for the consummation of sales of Villa plot and the associated construction of the villa in the same plot.

  • Once the plot allotted and the agreements signed to build the Villa, the total price of the land has to be paid to the owners of BHV, (seller) and the deed shall be registered in the name of the prospective Villa Owner(buyer)
  • Once the plot allotted and agreement signed, the prices are firm. However, any subsequent changes to the original plan are made by the buyer, per Sq.ft. price of the construction portion will be re-determined based on the new requirements.
  • All payment shall be made by Demand Draft or Certified Cheque in favor of the owners of Brook Haven Village Builders and Developers (BHV) in Indian currency or NRE, preferably U.S. dollars.
  • Measurements, area layout, elevation and specification may be changed by mutual negotiation. Floor plans are specific to each of the plot and subject to minor variations by the builder without specific or general notices.
  • Possession shall be given to the buyer only after setting all the financial and legal obligations related to the completion of the Villa, and any outstanding payment(s) due to the seller
  • Statutory payments, government charges like building tax and service tax to pay by the buyer. Also, buyer is responsible for all applicable deposits for power, water, Home Owner’s Association dues, and other government imposed service fees and any other customary dues.
  • Brook Haven Village Builders and Developers (BHV) reserves the right to accept or reject any application.
  • Brook Haven Village Villas is a time bound project. In case payments are not made as per the agreement signed, BHV reserves the right to cancel the allotment , in which case any previous payment made will be returned without any interest, only after the re-allotment to another buyer , and subject to the deduction of expenses and damages to BHV.

Payment to be made in five installments.

  On booking - 30% of total cost + Sales Tax  
  On completion of foundation - 25% of total cost + Sales Tax  
  On completion of ground floor roof - 25% of total cost + Sales Tax  
  On completion of first floor roof - 19% of total cost + Sales Tax  
  On handing over Entry Keys - 1% of total cost + Sales Tax  

Notes

  • All payment shall be made by Demand Draft or Certified Cheque in favor of the owners of Brook Haven Village Builders and Developers (BHV) in Indian currency or NRE, preferably U.S. dollars.
  • Statutory deposits, building tax, sales tax/vat , service tax, and the registrations charges are extra.
  • Common charges for common facilities should be paid to the building owners association, and the amount will be intimated.
  • Prices subject to change after the initial offer for further booking.
  • Maintenance of the common facilities is the responsibility of current villa owners.
